Child abduction is defined as the taking, taking away, keeping, withholding or concealing of any child with the intent to detain or conceal that child from the lawful custody or control of the parent, guardian or custodian of such child.
In order to be convicted of this crime, the defendant must be found guilty beyond a reasonable doubt by a jury of two (2) adults, and the jury must unanimously agree that the child was abducted by means of force, fraud, deceit, duress, menace, or fear of immediate and unlawful bodily injury or death.
The jury may not find that any other person was involved in the act of abduction.
In addition, if the victim is under the age of eighteen (18) years at the time the crime is committed, it is a felony punishable by imprisonment in a county jail for not more than one (1) year or a fine not to exceed one thousand dollars ($1,000), or by both such fine and imprisonment.

What are the types of child abduction?
There are two types of child abduction, parental and non-parental. This type of abduction occurs when a parent abducts a child from the custody of the child’s legal guardian or legal custodian. In this case, the parent may be the biological parent or the adoptive parent.

How do child abductions happen?
25% of kids are taken by strangers, while most are taken by a family member. Almost all kids kidnapped by strangers are taken by men, and about two thirds of boys and girls are kidnapped by women.
