A lewd or lascivious act, committed on the body or part of a child under 14, with the intent of arousing, appealing to, or gratifying the lust, passions, or sexual desires of any is one of the elements of a violation. The statute defines “child” as a “person under the age of 18 years.”
The definition of “sexual act” includes, but is not limited to: oral, anal, vaginal, and anal-genital contact; sexual intercourse; masturbation; and exhibition of the genitals or pubic area of one person to the genital or anal region of another. In addition, the statute provides that the offense is a Class A misdemeanor if the victim is less than 14 years of age.
The statute also provides for a fine of up to $1,000 and/or imprisonment of not more than one year.
